If I were to advise anyone today on creating a brand, I would tell her to start searching the Internet before searching the United States Patent and Trademark Office. Here's why:
What's more important? Trademarks? or Internet Domains?
The answer is you have to own the rights to both.
The internet has revolutionized the business of intellectual property. Sometimes an internet URL can be more valuable than a trademark, and it's infinitely cheaper to get.
If you're starting out
I would recommend you do a domain name search before you register your trademark. Owning the rights to an Internet domain name to your brand is essential, and even with all the .biz and .nets out there, I still think it’s best to own a .com domain.
"You Can't Own Everything"
That was the advice from my attorney, when I asked him if I should buy all the extensions available for my domain, like .biz, .org and .net. There is nothing you can do to protect yourself completely from squatters, or people who make a living squatting on the edges of other people's IP, then trying to sell it back to them or others.
Be sensible when buying domains. You can't own every itereation of your domain out there, no matter how hard you try to protect yourself from squatters. Just start by coming up with a domain name nobody ever thought of and you've got it covered.
